Conditions
The following general terms and conditions govern the contractual relationship between you as a customer and us as the operator of this online shop. The German version is legally binding; this translation is provided for convenience.
§ 1 Scope
These terms and conditions apply to all orders placed by consumers and businesses through our online shop with Roastau — Spezialitätenkaffee (hereinafter the "Provider"). A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession. Deviating terms of the customer are not recognised unless the Provider expressly agrees to their validity in writing.
§ 2 Conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer but a non-binding invitation to order. By clicking the order button you place a binding order for the goods contained in your cart. Receipt of your order is confirmed by email immediately after submission. This confirmation of receipt does not constitute acceptance of the offer. A purchase contract is only concluded when the Provider declares acceptance of the order by separate email or dispatches the goods.
Ordering steps. Put the products you want (coffee, size and grind) in the cart and click "Checkout". Then enter your billing and delivery address, as a guest or with a customer account, and choose the payment and shipping method. On the last page you check all details, accept these terms and place a binding order with the button "Order with obligation to pay".
Correcting input errors. Until you submit the order you can correct your entries at any time: change quantities or remove products in the cart, change addresses, payment and shipping method on the order overview, or return to earlier steps with your browser's back button. Closing the browser window cancels the ordering process.
Storage of the contract text. We store the contract text. You receive the order details by email with the order confirmation; with a customer account you can also view your orders under "My account". You can view and print these terms at any time on this page.
Contract languages. The contract can be concluded in German or English.
§ 3 Prices and shipping costs
All prices are final prices and include statutory VAT. Shipping costs may apply in addition to the stated prices. The amount of the shipping costs is shown separately during checkout and is part of the order summary before the order is placed.
§ 4 Delivery
Delivery is made to the delivery address you provide. We deliver to the countries listed during checkout. Information on the expected delivery time can be found on the respective product page and during checkout. If an ordered product is unavailable, we will inform you without delay and refund any payments already made.
§ 5 Payment
The payment methods shown during checkout are available to you. The purchase price is due upon conclusion of the contract unless expressly agreed otherwise. If a prepayment method is selected, the Provider ships the goods after receipt of payment.
§ 6 Retention of title
The delivered goods remain the property of the Provider until the purchase price has been paid in full.
§ 7 Right of withdrawal
Consumers have a statutory right of withdrawal. Details can be found in our cancellation policy.
§ 8 Warranty
The statutory provisions on liability for defects apply. If the delivered goods are defective, you are entitled to your statutory rights. For businesses, the warranty period for goods delivered by the Provider is one year from delivery.
§ 9 Liability
The Provider is liable without limitation for intent and gross negligence as well as under the German Product Liability Act. For slight negligence, the Provider is liable for damages resulting from injury to life, body or health and for the breach of essential contractual obligations. In the latter case, liability is limited to the foreseeable damage typical for this type of contract.
§ 10 Dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 11 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country of their habitual residence. Should individual provisions of these terms be invalid, the validity of the remaining provisions remains unaffected.
